Si, en vertu du droit interne de l’État d’émission, la personne condamnée doit être entendue par l’autorité judiciaire avant que ne soit rendue la décision sur le prononcé d’une peine, il peut être satisfait à cette exigence en appliquant mutatis mutandis la procédure figurant dans les instruments du droit international ou de l’Union européenne qui prévoient la possibilité d’avoir recours aux liaisons vidéo pour les auditions.
4. If, under the national law of the issuing State, the sentenced person must be given a judicial hearing before a decision is taken on the imposition of a sentence, this requirement may be met by following mutatis mutandis the procedure contained in instruments of international or European Union law that provide the possibility of using video links for hearing persons.
