49 Or, le deuxième moyen du pourvoi vise précisément à mettre en cause l’interprétation de l’article 74, paragraphe 1, du règlement n° 40/94 retenue par le Tribunal pour écarter le grief, soulevé dans le cadre du premier moyen de première instance, relatif à l’absence d’exemples concrets susceptibles d’étayer les affirmations de la chambre de recours concernant le caractère usuel de l’emballage en cause.
The second ground of appeal seeks specifically to call into question the interpretation of Article 74(1) of Regulation No 40/94 adopted by the Court of First Instance to dismiss the allegation, raised in the context of the first plea in law at first instance, concerning the lack of concrete examples capable of substantiating the Board of Appeal’s assertions regarding the customary nature of the wrappers at issue.
