Comme l'autre directive, elle prévoit par ailleurs un aménagement de la charge de la preuve (en matière civile), sur la base des dispositions déjà en vigueur dans le domaine de la discrimination fondée sur le sexe (directive 97/80/CE relative à la charge de la preuve), dès lors qu'une affaire de discrimination qui paraît fondée en première analyse est portée par un demandeur devant la Cour et acceptée par celle-ci.
Like the other Directive, it also provides for adaptation of the rules on the burden of proof (in civil matters) on the basis of provisions already in force in the field of discrimination on the basis of sex (Directive 97/80/EC on the burden of proof), in a case where there is prima facie evidence of discrimination which a petitioner brings before the Court, and the Court accepts it.
