I. whereas the Kazakh authorities have established a working group under the Prosecutor- General to reform the Criminal Code; whereas on 15 and 16 March 2013 a round table on the ‘Reform of the Criminal Code of Kazakhstan based on the principles of rule of law’ was held, with the participation of a delegation of the Venice Commission to advise on the reform; whereas the European Parliament has urged the Kazakh authorities to bring the country’s criminal law into line with international standards, including the reform of Article 164 on ‘inciting social discord’;

60. Calls on the Commission to prepare an EU Roadmap for equality on grounds of sexual orientation and gender identity, with a view to adoption by 2014, using the results of the survey launched by the European Agency for Fundamental Rights; calls for a recast of the Council Framework Decision on combating certain forms and expressions of racism and xenophobia by means of criminal law, including other forms of bias crime, such as on grounds of sexual orientation, gender identity and gender expression;

whereas so far the European Union has often developed criminal law provisions on an ad hoc basis, thus creating the need for increased coherence;

8. Requests that, unless the Council is determined to make progress in adopting a common position on the original Commission proposal, the Commission draw up a new proposal on the protection of the environment through criminal law on the basis of Article 175 of the EC Treaty, taking into account the Court of Justice's judgment and incorporating the result of the European Parliament's vote at first reading on the original proposal for a directive;
