Direct Community-wide licensing used to be provided by the framework agreement between authors' collecting societies and the association of phonogram producers (the BIEM/IFPI Agreement), which concerns mechanical reproduction rights.

Collecting societies administer rights in the area of music, literary and dramatic works as well as audiovisual works, productions and performances for activities such as communication to the public and cable retransmission of broadcasting programmes, mechanical reproductions, reprography, public lending, artist's resale right, private copying or certain educational uses.

Having regard to the freedoms established in the TFEU, collective management of copyright and related rights should entail a rightholder being able freely to choose a collective management organisation for the management of his rights, whether those rights be rights of communication to the public or reproduction rights, or categories of rights related to forms of exploitation such as broadcasting, theatrical exhibition or reproduction for online distribution, provided that the collective management organisation that the rightholder wishes to choose already manages such rights or categories of rights.

G. whereas under Directive 2001/29/EC Member States may provide for an exception to, or limitation on, the reproduction right for certain types of reproduction of audio, visual and audio-visual material for private use, accompanied by fair remuneration, and may allow consumers in countries having introduced such a limitation to copy their music and audio-visual collections from one medium or type of multimedia material to another freely and as frequently as they wish, without seeking authorisation from the rightholders, provided that this is for their private use; whereas any levies should be calculated on the basis of the possible harm ...[+++] to the rightholders resulting from the private copying act in question;
