Regrets the unnecessary complexity of the arrangements laid down in Article 28 of the EU Treaty with regard to the rapid financing of ESDP activities outside the EU budget; insists that the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (7), and the structured dialogue between the Council and Parliament envisaged therein, be fully implemented; in the longer term, calls for the Athena mechanism to be transferred to the CFSP budget while retaining its flexibility;

4. Is deeply concerned by recent cases in the EU relating to transfers of production facilities overseas, including licensed production deals, and regrets that this area was not addressed more substantially in the course of the review; reiterates that an operative provision is needed which regulates the manufacture, quantity and export of finished goods produced in facilities overseas and that the Common Position should set a deadline both for the drawing-up and for the entry into force of that provision; notes that the revised Code of Conduct (to be adopted in the form of ...[+++]a Common Position) will state that applications for licensed production overseas are to be assessed against the criteria of the Common Position;

increase the efficiency of the legal provisions by allowing the Member States a more realistic deadline for implementing decisions on the transfer of asylum-seekers and providing an appropriate framework for special implementation arrangements between Member States which jointly deal with a large number of cases involving the identification of the country responsible.

WHEREAS , IN ORDER TO ENSURE A BALANCED DEVELOPMENT OF PRODUCTION IN REGARD TO COMMUNITY NEEDS , MACHINERY FOR SUPERVISING THIS DEVELOPMENT SHOULD BE INTRODUCED ; WHEREAS , IN CASES WHERE THIS DEVELOPMENT WOULD LEAD TO THE QUANTITIES TAKEN OVER BY INTERVENTION AGENCIES AND THE VOLUME OF PRODUCTION EXCEEDING CERTAIN LIMITS , SUITABLE MEASURES TO ELIMINATE THE IMBALANCE SHOULD BE TAKEN ; WHEREAS PROGRAMMES OF AID FOR PRODUCERS AFFECTED BY THE SAID MEASURES MAY BE APPROVED ;

The second proposal has four aims: - to exclude fig bananas from the arrangements; - to simplify the system for allocating import duties by basing the distribution of the volume of the tariff quota and its management on actual quantities imported in the past (instead of quantities marketed); - to make provision for adjusting the tariff quota in exceptional circumstances; - to provide, where necessary, for a temporary transfer of quantities between ACP States in the same geographical area.
