reminds the Council that the EU should take a particular interest in securing the legacy of the Tribunal by ensuring that its archives are safely stored in a suitable secure location, possibly in the region of the Western Balkans, that they are as complete and as accessible as possible, and that documentation is accessible on the world-wide web; suggests that suitable guarantees of free access should also be given to all prosecutors and defence counsel and, after a suitable period of time, to historians and researchers;

This means freedom for individual researchers, but also freedom for state and regional aid for research and development.

Emphasises that a well-functioning internal market is important for successful development of the ERA and that the free movement of researchers in particular is vital; regrets that obstacles still hamper the mobility of researchers within the EU; calls for measures to improve the free flow of researchers, in particular by lifting all remaining transitional restrictions on the free movement of workers, as well as by improving the EU's research infrastructure; supports the creation of the European Institute of Innovation and Technology (EIT);

In addition to the measures in the field of education and training, the issue of the mobility of researchers was developed within the context of the implementation of the Commission Communication on "A Mobility Strategy for the European Research Area". [32] The following progress has been made: the Researchers' Mobility Portal [33] is on-line as of July 2003, and the European network of mobility centres for researchers (ERA-MORE) will be launched in early 2004.

In designing its mobility strategy for researchers in the ERA, the present Communication takes into account the approach towards researchers from candidate countries developed in the Commission decision on the negotiation mandates for enlargement [4], as well as the approach towards third country nationals developed within the Commission's amended proposals for a "Directive of the European Parliament and of the Council on the posting of workers who are third-country nationals for the provision of cross-border services" [5], and a "Council Directive extending the freedom to provide cross-border services to third-country nationals establis ...[+++]hed within the Community".
