It is clear from paragraph 1 of the first group of eligibility criteria contained in the vacancy notice that, according to Article 98 of the Staff Regulations, candidates must be officials of the General Secretariat of the Council of the European Union, of the Commission or of the EEAS, or temporary staff to whom Article 2(e) of the CEOS applies, that is to say, staff seconded from the national diplomatic services of the Member States engaged in order to occupy temporarily a permanent post within the EEAS, or staff from the national diplomatic services of the Member States.

Accordingly, it cannot reasonably be claimed that a competition notice infringes the principles of equal treatment and non-discrimination by allowing officials of an institution, including those seconded as temporary staff to the executive agencies, to apply for an internal competition, while denying access to temporary staff directly recruited by those agencies.

Since the proposal in question has no further purpose than to extend a temporary derogation brought about by Regulation (EC) No 546/2009, and since the Committee has already set out its views on the subject in its earlier opinion CESE 627/2009 (1), adopted on 24 March 2009, it decided, at its 474th plenary session of 21 and 22 September 2011 (meeting of 21 September 2011), by 160 votes to 2 with 12 abstentions, not to draw up a new opinion on the subject, but to refer to the position it had taken in the above-mentioned document.

Temporary requirements designed to amend non-essential elements of this Directive, by supplementing it, may be adopted, in accordance with the regulatory procedure with scrutiny referred to in Article 19(4) of this Directive, where it is found urgently necessary, for the purposes of adaptation to technical progress of inland waterway transport, to allow derogations from the provisions of this Directive or to allow tests.
