La requérante fait valoir, d’une part, que le règlement d’exécution est la réponse à une demande individuelle formulée par une société tierce et, d’autre part, que la limitation aux actes administratifs prévue à l’article 10, paragraphe 1, du règlement no 1367/2006, lu en combinaison avec l’article 2, paragraphe 1, sous g), du même règlement n’est pas compatible avec l’article 9, paragraphe 3, de la convention d’Aarhus (3).
The applicant submits, firstly, that the implementing regulation is the response to an individual application made by a third party undertaking and, secondly, that the restriction to administrative acts laid down in Article 10(1) of Regulation No 1367/2006, read in conjunction with Article 2(1)(g) of that regulation, is not compatible with Article 9(3) of the Aarhus Convention (3)
