The agreement defines the rules on the right of establishment for access to the market in services, and on the right of residence for professionals.

The motion makes it clear that these new agreements must be based on the constitutional, treaty and inherent rights of all first nations; the historical and fiduciary responsibilities of the Crown to first nations; the standards established in the UN Declaration on the Rights of Indigenous People, including the principle of free, prior and informed consent; respect, recognition, reconciliation and support for first nations; partnership and mutual accountability between the Crown and first nations; and the stability and safety of first nations as defined and prioritized by first nations.

In order to reconcile the need to ensure the effective enforcement of trade mark rights with the necessity to avoid hampering the free flow of trade in legitimate goods, the entitlement of the proprietor of the EU trade mark should lapse where, during the subsequent proceedings initiated before the European Union trade mark court (‘EU trade mark court’) competent to take a substantive decision on whether the EU trade mark has been infringed, the declarant or the holder of the goods is able to prove that the proprietor of the EU trade mark is not en ...[+++]titled to prohibit the placing of the goods on the market in the country of final destination.

3. Ownership rights shall cover all intellectual property rights within the meaning of Article 1(1) of Commission Regulation (EC) No 772/2004 of 27 April 2004 on the application of Article 81(3) of the Treaty to categories of technology transfer agreements as well as all property rights within the meaning of Article 2 of the Convention of the 14th July 1967 establishing the Intellectual Property World Organisation, and in particular trade mark rights.
