Where there is no genuine posting situation and a conflict of law arises, due regard should be given to the provisions of Regulation (EC) No 593/2008 of the European Parliament and of the Council (‘Rome I’) or the Rome Convention that are aimed at ensuring that employees should not be deprived of the protection afforded to them by provisions which cannot be derogated from by an agreement or which can only be derogated from to their benefit.

5. Welcomes the clause in the partnership and cooperation agreement concerning cooperation between the EU and Iraq in relation to the accession of Iraq to the Rome Statute of the International Criminal Court (ICC); stresses the importance of the EU providing maximum support for Iraq’s ratification of and accession to the Rome Statute as soon as possible, and for the implementation of international human rights standards and instruments as a matter of priority; calls on the Member States and on Iraq to ratify the statute changes of the ICC, adopted on 11 June 2010; applauds the clause in the partnership and cooperation agreement on coo ...[+++]peration in the promotion and effective protection of human rights in Iraq, with the caveat that failure by Iraq to protect, enhance and respect human rights would negatively affect cooperation and economic development programmes; stresses the importance of maintaining strict conditionality on the basis of the principle of ‘more for more’ and the need to put greater emphasis on the importance of substantial progress in relation to human rights in Iraq; welcomes the pledge by the Iraqi Government to promote effective dialogue with civil society and promote its effective participation;

1. In order to contribute to the objective of the widest possible participation in the Rome Statute, the Union and its Member States shall make every effort to further this process by raising the issue of the widest possible ratification, acceptance, approval or accession to the Rome Statute and the implementation of the Rome Statute in negotiations, including negotiations of agreements, or political dialogues with third States, groups of States or relevant regional organisations, whenever appropriate.

52. Reiterates its strong support for the International Criminal Court and its primary objective of fighting impunity for genocide, war crimes and crimes against humanity; welcomes the fact that the ratifications of the Rome Statute by Bangladesh, the Seychelles, Saint Lucia and Moldova in March, August and October 2010 brought the total number of States Parties to 114; stresses that the Rome Statute of the ICC was ratified by all the EU Member States as an essential component of the democratic principles and values of the Union and therefore calls upon the Member States to comply fully with the Statute as part of the EU acquis; under ...[+++]lines the importance of the principle of universality, and calls on the EEAS, the EU Member States and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the agreement on Privileges and Immunities of the International Criminal Court and national implementing legislation, and to review the Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the 2004 Action Plan to follow up on the Common Position; requests that such efforts be extended to the Agreement on the Privileges and Immunities of the ICC (APIC), an important operational tool for the Court; further calls on EU Member States to revise and update the Common Position and Action Plan on the ICC in order to reinforce effective assistance by the EU of the ICC in light of current developments, challenges and needs of the Court, as the warrants for arrest and trials at the ICC continue to increase in number, as well as to start discussions on the possible adoption of EU guidelines on international justice/ ICC;
