In violation of EU law and jurisprudence of the EU Court of Justice, the regional legislation on ski schools in the province of Styria always requires comprehensive alpine ski instructor qualifications and thus does not grant holders of separate specialist qualifications such as "Telemark ski instructors", "adaptive ski instructors" or "Nordic ski instructors" from other EU Member States any separate recognition of their qualifications and thus any partial access to the profession in the province concerned.

They would like to have their diploma recognised in France in order to exercise their profession there, as they are entitled to do under Community law. Die Richtlinie 92/51, die alle Mitgliedstaaten bis zum 18. Juni 1994 umzusetzen hatten, führt eine allgemeine Regelung zur Anerkennung beruflicher Befähigungsnachweise ein, mit denen eine höchstens dreijährige Berufsausbildung nach dem Abitur abgeschlossen wird (Eine gleichartige Anerkennungsregelung war mit der Richtlinie 89/48/EWG für Hochschuldiplome eingeführt worden, die eine mindestens dreijährige Berufsaufbildung abschließen.) Skilehrern, die ihre berufliche Qualifikation in einem anderen Mitgliedstaat erworben hatten, wurde in Frankreich systematisch die Anerkennung ihrer Diplome verweigert.
