With regard to cross-compliance obligations, apart from grading administrative penalties in view of the principle of proportionality, it should be provided that starting from a certain moment, repeated infringements of the same cross-compliance obligation should, after a prior warning to the farmer, be treated as an intentional non-compliance.
In Bezug auf die Cross-Compliance sollte neben einer Staffelung der Verwaltungssanktionen zwecks Beachtung des Grundsatzes der Verhältnismäßigkeit vorgesehen werden, dass ab einem bestimmten Zeitpunkt wiederholte Verstöße gegen dieselbe Cross-Compliance-Verpflichtung nach vorheriger Verwarnung des Betriebsinhabers als vorsätzliche Verstöße betrachtet werden.
