The conditions which may be imposed by the Commission may include, but are not limited to, burden-sharing requirements, including a requirement that losses are first absorbed by equity, and requirements as to contributions by hybrid capital holders, subordinated debt holders and senior creditors, including in accordance with the requirements of Directive 2014/59/EU; restrictions on the payment of dividends on shares or coupons on hybrid capital instruments, on the repurchase of own shares or hybrid capital instruments, or on capital management transactions; restrictions on acquisitions of stakes in any undertaking either through an ass ...[+++]et or share transfer; prohibitions against aggressive commercial practices or strategies, or advertising support from public aid; requirements concerning market shares, pricing, product features or other behavioural requirements; requirements for restructuring plans; governance requirements; reporting and disclosure requirements, including as regards compliance with such conditions as may be specified by the Commission; requirements relating to the sale of the beneficiary or of all or part of its assets, rights and liabilities; requirements relating to the liquidation of the beneficiary.

(Return tabled) Question No. 308 Mr. Guy Caron: With regard to the Guaranteed Income Supplement (GIS) Program: (a) since 2003, in Canada and for each province, (i) how many overpayment recovery decisions were made by Service Canada, (ii) how many of these decisions were made concerning a problem with a beneficiary’s marital status; (b) under which policy, government directive, legislation or regulation is the Canada Revenue Agency (CRA) authorized to share personal information with Service Canada about the marital status of taxpayers ...[+++] regarding their GIS file, and where can it be accessed; (c) since 2002, in Canada and in each province, how many individuals, annually, receive GIS benefits; (d) since 2002, in Canada and in each province, how many individuals, annually, qualify for GIS benefits but do not receive them, regardless of the reason; (e) why, between July 2003 and 2011, did Service Canada not have access to the marital status of GIS beneficiaries despite the information sharing protocol it has with the CRA; (f) why did Service Canada (or the department at the time) set aside certain notices of debt regarding overpayment recovery decisions involving GIS beneficiaries between June 1995 and July 2003; and (g) between 2003 and 2013, were there any cases where Service Canada reviewed GIS benefit files to determine whether the government owed amounts to individuals for whom the change in marital status was to their advantage financially, and if so, how many cases per year?

Nevertheless, the principle according to which a beneficiary may not exercise discretion when awarding financial support to third parties should be maintained, in particular to avoid any confusion between the possibility offered to beneficiaries to design and implement, under their responsibility, actions which involve financial support as an eligible activity and the possibility to entrust budget implementation tasks under shared or indirect management to certain bodies, entities or persons.

4. Where the net cost is shared in accordance with paragraph 3(b), Member States may establish a compensation fund which may be funded by service providers and/or users' fees, and is administered for this purpose by a body independent of the beneficiary or beneficiaries.

Over the last four years the Commission received a substantial number of letters concerning the different charging options used by banks. These are: 'OUR' (all charges are borne by the originator), 'BEN' (all charges are borne by the beneficiary) and 'SHARE'(charges are shared between the originator and the beneficiary).

This measure relates to registered disability savings plans and provides for the rollover or transfer of investment income earned in a registered education savings plan to an RDSP in certain circumstances, particularly where the RESP and the RDSP share a beneficiary and that beneficiary is unable to pursue post-secondary education as a result of a mental impairment.
