On the basis of the above assessment, the Commission takes the view that the main terms and conditions of the purchase obligation enshrined in the PPAs, i.e. the capacity reservations and guaranteed off-take by MVM under such conditions as to ensure the return on investment of the power plants by shielding them from the commercial risks of the operation of their plant, constitute State aid within the meaning of Article 87(1) of the EC Treaty.
Sur la base de l’analyse ci-dessus, la Commission considère que les principales conditions de l’obligation d’achat figurant dans les AAE, à savoir les mises en réserve de capacités et les achats garantis par MVM dans des conditions telles qu’elles garantissent le retour sur investissement des centrales en les protégeant des risques commerciaux liés à leur exploitation constituent une aide d’État au sens de l’article 87, paragraphe 1, du Trait CE.
