42 (2.1) No employer or person acting on behalf of an employer shall use, for the demonstrated purpose of undermining a trade union's representational capacity rather than the pursuit of legitimate bargaining objectives, the services of a person who was not an employee in the bargaining unit on the date on which notice to bargain collectively was given and was hired or assigned after that date to perform all or part of the duties of an employee in the bargaining unit on strike or locked out.
42 (2.1) Il est interdit à tout employeur ou quiconque agit pour son compte d'utiliser, dans le but établi de miner la capacité de représentation d'un syndicat plutôt que pour atteindre des objectifs légitimes de négociation, les services de toute personne qui n'était pas un employé de l'unité de négociation à la date de remise de l'avis de négociation collective et qui a été par la suite engagée ou désignée pour exécuter la totalité ou une partie des tâches d'un employé de l'unité de négociation visée par une grève ou un lock-out.
