4. Any exchange of personal data with third countries in the framework of EUROSUR shall be strictly limited to what is absolutely necessary for the purposes of this Regulation.

At the same time – in view of the fact that, as underlined by the Court of Justice of the EU[24], the right to the protection of personal data is not an absolute right, but must be considered in relation to its function in society[25] and be balanced with other fundamental rights, in accordance with the principle of proportionality[26] – the Regulation will include explicit provisions that ensure the respect of other fundamental rights, such as freedom of expression and information, the right to defence, as well as of professional secrecy (such as for the legal profession), without prejudicing the status of churches under the laws of the ...[+++] Member States.

The ECtHR has established that, while the right of a person charged with a criminal offence to be effectively defended by a lawyer is not absolute, any exception to the exercise of this right should be clearly circumscribed and strictly limited in time[22] and it must not, in the light of the entirety of the proceedings, deprive the accused of a fair hearing[23].

Protection of personal data: Since the transmission, use and processing of PNR data affects the fundamental right of individuals to protection of their personal data, it is of central importance that the EU only cooperates with those third countries that can provide an adequate level of data protection for the EU originating PNR data.
