La Cour a par ailleurs souligné que, en vertu de l'article 7, paragraphe 4, cinquième alinéa, du règlement (CEE) n° 259/93 concernant les transferts de déchets, les États membres pouvaient s'opposer aux transferts «si le rapport entre les déchets valorisables et non valorisables, la valeur estimée des matières qui seront finalement valorisées ou le coût de la valorisation et le coût de l'élimination de la partie non valorisable sont tels que la valorisation ne se justifie pas d'un point de vue économique et écologique».
