Dans l’affaire C-46/08, le Schleswig-Holsteinische Verwaltungsgericht (tribunal administratif de Schleswig Holstein) doit, en revanche, décider si c'est à bon droit que le Land de Schleswig Holstein a rejeté la demande de l'entreprise Carmen Media Group de pouvoir offrir des paris sportifs en Allemagne via Internet, alors qu'elle bénéficie déjà à Gibraltar, où elle a son siège, d'une licence « off-shore » ne l'autorisant à organiser des paris qu'en dehors de Gibraltar.
