On the second method, France states that it follows from the Commission decision on the State aid implemented by Belgium for ABX Logistics, in which the Commission examined a negative sale price, having, as in this case, the character of a market price, by comparing it to the costs which the State shareholder would actually bear in the event of a voluntary liquidation or compulsory liquidation as assessed by an independent third party.
Sur la seconde méthode, la France indique qu’elle découle de la décision de la Commission concernant l’aide d’État mise à exécution par la Belgique en faveur d’ABX Logistics, dans laquelle la Commission a examiné un prix de cession négatif, présentant, comme en l’espèce, le caractère d’un prix de marché, en le comparant aux coûts que l’État actionnaire aurait effectivement supportés dans le cadre d’une liquidation amiable ou judiciaire tels qu’expertisés par un tiers indépendant.
