Ainsi, sur l'insistance du Royaume-Uni, auquel s'est joint en fin de parcours la Pologne, la CIG a ajouté un Protocole (nº 9) sur l'application de la Charte des droits fondamentaux à la Pologne et au Royaume-Uni, dans lequel on précise que la Charte n'étend pas la faculté de la Cour de justice ou des juridictions de ces deux pays "d'estimer que les lois, règlements ou dispositions, pratiques ou actions administratives de la Pologne ou du Royaume-Uni sont incompatibles avec les droits, les libertés et les principes fondamentaux qu'elle réaffirme".
