Articles 39 octies A and D of the French General Tax Code allow a firm temporarily to deduct from its tax base either the losses incurred by its subsidiaries or certain establishments located abroad, which losses in the case of commercial or service investments are restricted to the amount of the investment and subject to a possible ceiling, or in the case of industrial or agricultural investments part of the investments made by those subsidiaries and establishments.
Les articles 39 octies A et D du Code Général des Impôts français prévoient la possibilité pour une entreprise de déduire temporairement de sa base imposable soit les pertes, limitées au montant de l'investissement éventuellement plafonné (dans les cas d'investissements à caractère commercial ou de services), soit une partie de ces investissements (investissements à caractère industriel et agricole) réalisés dans ses filiales ou certains établissements situés à l'étranger.
