Lorsqu'un État membre étend l'application d'un acte juridique de l'Union ouvrant un secteur donné à la concurrence à des situations qui ne relèvent pas du champ d'application de cet acte juridique, par exemple en appliquant la directive 94/22/CE du Parlement européen et du Conseil au secteur du charbon ou la directive 2012/34/UE du Parlement européen et du Conseil au service passagers au niveau national, cet élément devrait être pris en compte au moment d'évaluer si l'accès au secteur concerné est libre en droit et en fait.
Where a Member State extends the application of a Union legal act opening up a given sector to competition to situations falling outside the scope of that legal act, for instance by applying Directive 94/22/EC of the European Parliament and of the Council to the coal sector or Directive 2012/34/EU of the European Parliament and of the Council to passenger service at the national level, that circumstance should be taken into account when assessing whether access to the sector concerned is free.
