Les États membres, comme le Royaume-Uni, qui appliquent actuellement sur le gazole un taux d'accise 1,5 fois supérieur au taux pivot communautaire, seraient autorisés à appliquer un taux en dehors de la marge de fluctuation pendant une durée de sept ans à compter de 2003; ils seraient toutefois tenus d'adopter un plan de convergence visant à faire entrer leur taux dans la marge de fluctuation le 31 décembre 2009 au plus tard.
Those Member States, such as the United Kingdom, which currently apply a rate of excise duty to diesel more than 1.5 times higher than the central Community rate, would be able to apply a rate outside the fluctuation band for a period of seven years from 2003 but would have to adopt a convergence plan to bring their excise duty within the band by 31 December 2009.
