Since the objective of this Directive, namely the development of the Community’s railways, cannot be sufficiently achieved by the Member States, given the need to ensure fair and non-discriminatory conditions of access to infrastructure and to take account of the obviously international dimension of the way in which important parts of the rail networks operate, as well as the need for coordinated transnational action, and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

However, in particular market segments, e.g. where there is high demand for access, the charges should not end up with an exclusion of undertakings that can only pay the costs directly incurred as a result of the train operation costs, plus a rate of return which the market can bear.

76. At the request of a railway or other surface transport company or sea company operating between France and Italy (an "Intermodal Partner"), the Parties shall enter into an intermodal agreement whereby they provide passenger air transport on their services on any Affected Route as part of an itinerary that includes surface or sea transportation by the Intermodal Partner.
