Professor Grant Huscroft of the University of Western Ontario, which I think you all know was founded by a great Moncton jurist, Ivan Cleveland Rand, said recently that perhaps the reason the Conservative government has turned somewhat on the idea of judicial appointments and why there are, in some quarters, musings about elected judges is that there is a reaction to judicial activism with respect to the interpretation of the charter over these many years.
