The COP/MOP 5 also decided that additional and supplementary compensation measures may be taken in instances where the costs of response measures provided for in the Supplementary Protocol are not covered and that those measures may include arrangements to be addressed by the COP-MOP.

The Additional Protocol containing the abovementioned technical changes concerning the inclusion of Bulgaria and Romania were agreed with the Republic of South Africa, On 9 October 2007 Council adopted a decision on the signing and provision application of the Additional Protocol.

The draft was based on the Commission proposal for a Council Act drawing up the additional Protocol to the Convention on the protection of the European Communities' financial interests and for the Protocol to the Convention on the protection of the European Communities' financial interests pursuant to Article K.3 of the Treaty on European Union (COM(95)0693).

It seems both desirable and necessary that the scope of the 'second' supplementary protocol to the Convention should include corruption as referred to in Articles 2 and 3 of the 'first' supplementary protocol, because in cases of fraud, attempts are frequently made to bribe individual decision-makers at national and European institutions.
