La Cour relève que, pour apprécier la sélectivité d’une mesure adoptée par une entité infra étatique qui fixe, dans une partie du territoire d’un État membre, un taux d’imposition réduit, il faut examiner si ladite mesure a été prise par cette entité dans l’exercice de pouvoirs suffisamment autonomes par rapport au pouvoir central.
The Court observes that, in order to determine the selectivity of a measure adopted by an infra- State body which establishes a lower tax rate in part of the territory of a Member State, there must be an examination of whether that measure was adopted by that body in the exercise of powers sufficiently autonomous vis-à-vis the central power.
