Pour donner un exemple, il est contraire à l’esprit du règlement d’exiger des employeurs allemands qu’ils s’acquittent de formalités administratives excessives, afin de restituer à la Pologne des contributions de sécurité sociale équivalant à 47,85 % (20,64 % à charge de l’employeur, 27,27 % à charge du travailleur) de la rémunération des travailleurs saisonniers polonais, en particulier quand le droit allemand n’imposait pas le versement de telles contributions dans ce cas, avant l’adhésion de la Pologne à l’UE.
It is, then, to give one example, contrary to the spirit of the Regulation for German employers to be required to grapple with an intolerable amount of red tape in order to remit to Poland social security contributions totalling 47.85% (20.64% from the employer, 27.27% from the employee) of the earnings of Polish seasonal workers, particularly when, under German law, no such contributions were payable in respect of their work prior to the accession of Poland to the EU.
