Par requête déposée au greffe de la Cour le 31 mai 1996, la Commission des Communautés européennes a introduit un recours visant à faire constater que, en adoptant le décret no 93-999, du 9 août 1993, relatif aux préparations à base de foie gras (ci-après le «décret»), sans avoir tenu compte des termes de l'avis circonstancié et de l'avis motivé de la Commission relatifs à la reconnaissance mutuelle, la République française a manqué aux obligations qui lui incombent en vertu de l'article 30 du traité CE.
By application lodged at the Court Registry on 31 May 1996, the Commission of the European Communities brought an action for a declaration that, by adopting Decree No 93-999 of 9 August 1993 relating to preparations with foie gras as a base ('the Decree'), without taking account of the contents of the detailed opinion and the reasoned opinion of the Commission concerning mutual recognition, the French Republic has failed to fulfil its obligations under Article 30 of the Treaty.
