a) il existe entre les membres de la conférence au sein de laquelle le consortium opère une concurrence effective en matière de prix, du fait que ses membres sont autorisés expressément par l'accord de conférence, en vertu d'une obligation légale ou non, à appliquer l'action tarifaire indépendante à tout taux de fret prévu par le tarif de la conférence; ou
(a) there is effective price competition between the members of the conference within which the consortium operates, due to the fact that the members are expressly authorised by the conference agreement, whether by virtue of a statutory obligation or otherwise, to apply independent rate action to any freight rate provided for in the conference tariff; or
