L’Oberster Gerichtshof cherche en outre à savoir si les droits fondamentaux reconnus au niveau de l’Union s’opposent à ce qu’un juge national interdise à un fournisseur d’accès, par voie d’injonction, d’accorder à ses clients l’accès à un site Internet qui met en ligne des objets protégés sans l’accord des titulaires de droits, lorsque cette injonction ne précise pas quelles mesures le fournisseur d’accès doit prendre et que ce dernier peut échapper aux astreintes visant à réprimer la violation de l’injonction en prouvant qu’il a pris toutes les mesures raisonnables.
The Oberster Gerichtshof also seeks to know whether the fundamental rights recognised at EU level preclude a national court from prohibiting an ISP, by means of an injunction, from allowing its customers access to a website which places protected subject-matter online without the agreement of the rightholders, when that injunction does not specify the measures which the ISP must take and when that ISP can avoid incurring coercive penalties for breach of the injunction by showing that it has taken all reasonable measures.
