2. Proposes that the Commission might consider whether an optional European legal framework for these European TCAs would be necessary and useful in order to provide greater legal security, greater transparency, and foreseeable and enforceable legal effects for agreements following the framework provisions; proposes that practices relating to European TCAs should be promoted which recognise the contractual autonomy of the contracting parties, and recommends that provisions be incorporated in the agreements concerning dispute resolution;

1. The Commission may by Regulation and in accordance with Article 81(3) of the Treaty, declare that Article 81(1) of the Treaty shall not apply to certain categories of agreements between undertakings, decisions of associations of undertakings and concerted practices that have as an object to promote or establish cooperation in the joint operation of maritime transport services between liner shipping companies, for the purpose of rationalising their operations by means of technical, operational or commercial arrangements with the exception of price fixing (consortia).

(a) mobile workers are informed of the relevant national requirements, the internal rules of the undertaking and agreements between the two sides of industry, in particular collective agreements and any company agreements, reached on the basis of this Directive, without prejudice to Council Directive 91/533/EEC of 14 October 1991 on an employer's obligation to inform employees of the conditions applicable to the contract or employment relationship(6).

Blak list”: maintain a central database, in line with best practice in international organisations such as the World Bank, containing the names of companies and individuals found to have defrauded the Union budget so as to avoid contracts being granted by different departments to the same companies or individuals; asks that details of convicted defrauders are published on the Commission website; regrets that an early warning system, the so called grey list, is poorly understood and is not strictly enforced throughout the Commission; points out that no preferential treatment should be given to organisations with direct links to persons ...[+++] working or having worked in European institutions; asks that both the Blak and grey lists be cross-referenced to the central register of invoices foreseen in April 2001 under Action 11 of the White paper on Reform (COM(2000) 200 ) and to the central contracts database foreseen in June 2001 under Action 74 of the White paper on Reform; asks the Commission to put forward proposals to amend the Council Regulation (EC) No 1469/95 of 22 June 1995 on measures to be taken with regard to certain beneficiaries of operations financed by the Guarantee Section of the EAGGF in order to list companies under suspicion of wrongdoing or fraud; asks the Commission to ensure that all external contractors indicate whether they have worked in European institutions; reserves the right to make enquiries concerning individual contracts; calls on the Commission to put forward a proposal for a legal base enabling the Commission to add the names of companies and individuals to the Blak list;

2. To ensure the elimination of distortions to sound competition and with due consideration to the different levels of development and economic needs of each ACP country, they undertake to implement national or regional rules and policies including the control and under certain conditions the prohibition of agreements between undertakings, decisions by associations of undertakings and concerted practices between undertakings which have as their object or effect the prevention, restriction or distortion of competition.

2. To ensure the elimination of distortions to sound competition and with due consideration to the different levels of development and economic needs of each ACP country, they undertake to implement national or regional rules and policies including the control and under certain conditions the prohibition of agreements between undertakings, decisions by associations of undertakings and concerted practices between undertakings which have as their object or effect the prevention, restriction or distortion of competition.
