À cet égard, la Cour de Justice a, selon une jurisprudence constante, indiqué que la dimension et l’intérêt communautaire d’une affaire se déterminent en fonction de ses effets sur le commerce intra-communautaire et que les pratiques en cause exercent une influence sur les courants d’échanges entre États membres dans un sens qui pourrait nuire à la réalisation des objectifs d’un marché unique (voir notamment CJCE, AEPI c Commission, aff. C-425/07P, spé. §42).
In this regard the Court of Justice, in accordance with established case law, has indicated that the Community dimension and interest of a case are determined on the basis of its effects on intra-Community trade and of whether the practices in question exert an influence on the trade flows between Member States in a way that could harm the achievement of the objectives of a single market (see in particular ECJ, AEPI v Commission, Case C-425/07P, specifically §42).
