2. By way of derogation from Article 53(3), at the request of a Member State, payments of the final balance shall be increased by an amount corresponding to 10 percentage points above the co-financing rate applicable to each priority axis, up to a maximum of 100 %, to be applied to the amount of eligible public expenditure newly declared in each certified statement of expenditure submitted during the period in which a Member State fulfils one of the conditions laid down in points (a), (b) and (c) of Article 76(3).

Based on the examination referred to above, it is my opinion that the final statement of expenditure presents fairly, in all material respects, the expenditure paid under the operational programme, that the application for payment of the balance of the Community contribution to this programme is valid and that the underlying transactions covered by the final statement of expenditure are legal and regular, except with regard to the matters referred to at point 2 above and/or to the observations at point 3 regarding the error rates and ...[+++]cases of irregularity and the way they have been dealt with by the managing authority, the impact of which is quantified above.

53. It is the responsibility of each Member State to determine the exact procedure for implementing the minimum standards established above in point 52; Member States which so wish may introduce additional procedures (in particular residence certificate in every case).

Until now, in its negotiations with the Americans, the Commission has put forward the scenario that the United States will not be able to jam one of the planned PRS signals because it will be overlaid on one of the future military GPS signals and it is not possible to selectively jam one of two signals overlaid on a single frequency band with the same modulation. As explained in point3.3 hereabove, the modulation used for the overlay would enable Galileo to transmit a much more "robust" and reliable signal. As a result, the United States would not be able to selectively jam Galileo PRS users. A political agreement on the cooperation nece ...[+++]ssary between the two radionavigation systems is required in preparation for a crisis or in the event of a crisis.

G. The abovementioned Member States declare their firm intention to sign an agreement on the introduction of a user charge as described in A - F before 1 January 1994. If one or more of these Member States would not be in the situation to accept this user charge on 1 January 1995, the other Member States or only one Member State may introduce the user charge on their or on its respective territory, as described in A - F. H.

5. INVITES THE COMMISSION: 5.1. to propose to the Council, before 1 July 1994, the measures necessary for the realization of the policy goals set out under 4.1 to 4.11 above with a view to implementing without delay a Community policy on postal services, particularly measures - containing the definition of the universal service, describing the obligations of the providers of the universal service and defining the services which could be reserved; - relating to the quality of the universal intra-Community service; - relating to technical standardization; 5.2. to base its proposals for future regulation ...[+++] of the postal services on measures which are transparent, simple and easy to manage, to ensure the best possible conditions of monitoring and enforcement; 5.3. to contribute actively, on the basis of current proceedings and in co-operation with the Member States, to the definition of a clear framework for a new terminal dues system, bearing in mind the need to ensure satisfactory protection against deflections of trade based on abuse and to forward to the Council before 1 March 1994 any further action which could prove necessary in this area; 6. INVITES THE MEMBER STATES: 6.1. to support the above major policy goals; 6.2. to work in association with the Commission, particularly within the SOGP and a high-level committee of the authorities, in the implementation of a Community postal services policy in conformity with the above major policy goals; 6.3. to conduct, in association with their universal service providers, appropriate discussions in order to agree on a new terminal dues system, including steps to ensure compatibility with other systems".
