While the operations fall under the jurisdiction of the requesting Member State, the requested Member State’s officers may act only within the limits of their powers as defined by their national law.

Taking into account the exceptional nature of such a possibility, it is also appropriate, within this limited period of time and for a limited number of services, to allow those Member States that have completely opened up their markets to refuse monopolies operating in another Member State authorisation to operate in their own territory.

As regards derivative instruments not admitted to trading but falling within the scope of this Directive, every Member State should be competent to sanction actions undertaken within its territory or abroad and which concern underlying financial instruments admitted to trading on a regulated market located or operating within its territory or for which a request for admission to trading on such a regulated market has been made.
