2. Lorsque la mesure de protection a été ordonnée par défaut de comparution, le certificat ne peut être délivré que si la personne à l’origine du risque encouru s’est vu signifier ou notifier l’acte introductif d’instance ou un document équivalent, ou si, le cas échéant, elle a été informée de l’ouverture de la procédure par d’autres moyens conformément au droit de l’État membre d’origine, dans un délai suffisant et d’une manière lui permettant de préparer sa défense.
2. Where the protection measure was ordered in default of appearance, the certificate may only be issued if the person causing the risk had been served with the document which instituted the proceeding or an equivalent document or, where relevant, had been otherwise informed of the initiation of the proceeding in accordance with the law of the Member State of origin in sufficient time and in such a way as to enable that person to arrange for his or her defence.
