Même si une affaire relevait exclusivement de la compétence de la province et que le sous-procureur général de l'Ontario avait déjà accepté la participation du témoin concerné au programme ontarien, la GRC insistait pour juger de manière indépendante l’admissibilité du candidat à la protection des témoins selon les critères établis dans la LPPT du Canada, en vue d’admettre – ou non – le témoin dans son programme.
Notwithstanding that the case fell exclusively within provincial jurisdiction and the witness had been previously accepted into Ontario’s program by Ontario’s Deputy Attorney General, the RCMP insisted that they independently review the suitability of the witness for witness protection on the basis of the criteria in the federal WPPA and then admit or not admit the witness into their program.
