Un établissement devrait être considéré comme défaillant ou susceptible de l’être s’il enfreint ou est susceptible dans un proche avenir d’enfreindre les exigences attachées au maintien de l’agrément, si son actif est ou est susceptible dans un proche avenir d’être inférieur à son passif, s’il est ou est susceptible dans un proche avenir d’être dans l’incapacité de payer ses dettes à l’échéance, ou s’il sollicite un soutien financier public exceptionnel, sauf dans les circonstances particulières définies dans la présente directive.
An institution should be considered to be failing or likely to fail when it infringes or is likely in the near future to infringe the requirements for continuing authorisation, when the assets of the institution are or are likely in the near future to be less than its liabilities, when the institution is or is likely in the near future to be unable to pay its debts as they fall due, or when the institution requires extraordinary public financial support except in the particular circumstances laid down in this Directive.
