In the Scott case, the ECJ stressed the importance of the time-dimension in the recovery process.

In its recent Scott judgment (32), the ECJ confirmed that line and emphasised that national procedures which do not fulfil the conditions laid down in Article 14(3) of the Procedural Regulation should be left unapplied.
