1. This Framework Decision seeks to facilitate the social re-integration of sentenced persons, to improve the protection of victims and society and to facilitate the application of appropriate suspended sentences, alternative sanctions and conditional sentences in the case of offenders who are not resident in the sentencing State.

28. Considers that the costs of enforcing custodial and pecuniary penalties should be borne by the state in which enforcement takes place since in the long term these costs will be balanced over all the Member States;

n) make a custody and supervision order of up to three years, where the young person was found guilty of an offence punishable by life imprisonment under the Criminal Code, or up to two years, in any other case – under this sentence, the young person would be ordered to spend two-thirds of the period in custody, and one-third in the community under conditions (this designated period of supervised release would be analogous to statutory release for adults under the Corrections and Conditional Release Act, and would be a change from the current custody disposition under YOA s. 20(1)(k));

Upon the third such determination, a young person who was at least 14 (depending on whether the province has opted to set a higher minimum age for the presumptive application of adult sentences under clause 61) would be subject to an adult sentence, unless the young person could satisfy the court that a youth sentence would be sufficient to hold him or her accountable.
