42 (1) A person who becomes a contributor under this Act, having been enrolled as an officer of the regular force for a fixed period of service before becoming a contributor, is entitled to count as pensionable service for the purposes of this Act any period of service in the regular force during which the contributor was so enrolled, except any such service described in clause 6(b)(ii)(D), if the contributor elects, within one year of becoming a contributor under this Act, to pay for that service, in which case the amount required by this Act to be paid by the contributor is, subject to subsections (1.1) and (1.2), an amount equal to th ...[+++]e greater of

(4) When a person who is a contributor or survivor has become entitled under this Part to an annuity or annual allowance the amount of which would be less than two per cent of the Year’s Maximum Pensionable Earnings within the meaning of subsection 11(3) in respect of the year in which the request is made, there may be paid to that person, on request by that person, to the Minister in writing within three months from the day on which written notice is sent by the Minister informing the person of the amount of the annuity or annual allowance, an amount determined in accordance with the regulations to be the capitalize ...[+++]d value of the annuity or annual allowance, which payment shall be in lieu of any other benefit under this Part and Part III.

It should therefore be possible to limit the claim to the ticket price and treat the amounts specified as the permitted maximum. The amount in question may, however, be paid twice over if the outward and return flights are both delayed.

The amount of such administrative penalties for a given year shall not exceed 0 % for the first two years of application of Chapter 3 of Title III of Regulation (EU) No 1307/2013 (claim years 2015 and 2016), 20 % for the third year of application (claim year 2017) and 25 % starting with the fourth year of application (claim year 2018), of the amount of the payment referred to in Chapter 3 of Title III of Regulation (EU) No 1307/2013 to which the farmer concerned would be entitled if the farmer met the conditions for that payment.

Although consolidated data on the number of decisions adopted and penalties imposed by national enforcement authorities are not available, the following representative examples can be provided: between the entry into force of the Directive and mid 2011, the Italian Competition Authority issued more than 700 decisions and applied administrative fines totalling € 91 million; the French General Directorate for Competition, Consumer Issues and Fraud Control (DGCCRF) issued 1251 Reports[124] and corresponding fines amounting to approximately € 1.7 million were imposed; [125] the Latvian Consumer Rights Protection Centre took 154 binding deci ...[+++]sions and imposed fines of € 159 400; the Finnish Consumer Ombudsman initiated 8 court cases; the Irish National Consumer Agency issued 14 undertakings, 116 compliance notices, 2 prohibition orders, and started 2 prosecutions; the Slovak Trade Inspection issued 46 administrative decisions and imposed a total amount of € 151 800 in fines; and, finally, 18 court rulings and 52 injunction orders were issued in Sweden.

The amount of duty is equal to a fixed amount per tonne of KCI per type and grade, or the difference between the prices indicated in the Regulation and the net, free-at-Community-frontier price per tonne of KCI, before customs clearance for the corresponding type and grade, whichever is the higher.
