S’il est pourtant un domaine où la législation européenne aurait totalement sa légitimité, c’est dans l’harmonisation, non pas des lois de fond, qui aboutirait à uniformiser le droit dans tous les pays membres, mais l’harmonisation des règles de conflits de juridictions, d’abord pour savoir quel est le tribunal compétent et, ensuite, l’harmonisation des règles de conflits de lois, c’est-à-dire quelle est la loi applicable.
If there is one area in which European legislation has complete legitimacy, it is the harmonisation not of substantive law, which would result in the standardisation of law across all the Member States, but of the rules governing conflicts of jurisdiction – primarily so as to know which court has jurisdiction – and, secondly, of the rules governing conflicts of laws; in other words, establishing which law applies.
