75. Nonobstant les dispositions de la présente loi, le ou après le trente et unième jour de mars 1933, lorsqu’u
n colon détient par achat du directeur un outillage sur lequel le directeur converse un titre en attendant que le colon ait acquitté complètement le paiement du solde du prix d’achat de cet outillage, ou sur lequel le directeur possède une charge, un privilège ou une autre servitude par suite des avances consenties au colon conformément aux dispositions de la présente loi,
les droit, titre et intérêt du directeur afférents à
...[+++]cet outillage sont abandonnés par lui en faveur du colon; néanmoins, cet abandon ne doit aucunement exempter le colon de son obligation de verser au directeur le solde resté impayé du prix d’achat de cet outillage avec l’intérêt couru, ni du remboursement de tout montant garanti par un privilège, une charge ou autre servitude à l’égard de cet outillage; de plus, cet abandon de titre ne doit pas être consenti en faveur du colon lorsque ce dernier a, du consentement du directeur, cédé son intérêt dans cet outillage à une autre personne envers laquelle le directeur s’est engagé à remettre un titre clair, pourvu que cette personne ait rempli certaines obligations envers le directeur.75. Notwithstanding anything in this Act, on or after the thirty-first day of March, 1933, in the case of any settler holding under purchase from the Director any equipment to which the Director retains title pending the completion by the settler of the payment of balance of the purchase price thereof, or on which the Director has a charge, lien, or other encumbrance as the result of any advances made to the settler pursuant to the provisions of this Act, the Director
’s right, title and interest in such equipment shall be released by the Director in favour of the
settler; provided that ...[+++] such release shall in no way relieve the settler from the payment by him to the Director of the balance of the purchase price of such equipment remaining unpaid together with accrued interest, or from the repayment of any amount secured by a lien, charge or other encumbrance against such equipment; provided further that no such release of title shall be made in favour of the settler where the settler has with the Director’s consent assigned his interest in such equipment to another party to whom the Director is obligated to deliver clear title upon the fulfilment by such party of certain obligations to the Director.
