E. whereas at the European Council on 19 June 2009 the Heads of State or Government agreed to take a decision in order to provide ‘necessary legal guarantees’ responding to the concerns of the Irish people in relation to the right to life, family and education, taxation, security and defence, and agreed that they would, at the time of the conclusion of the next accession treaty and in accordance with their respective constitutional requirements, set out the provisions of the decision in a protocol to be attached to the Treaty on Euro ...[+++]pean Union and the Treaty on the Functioning of the European Union as clarifications of the provisions of the Treaty of Lisbon with respect to the Irish concerns;

50. Notes, however, that the Financial Regulation should incorporate all the provisions needed to define the budgetary procedure, in accordance with the provisions of the Treaty ; takes the view that such provisions would cover the functioning of the Conciliation Committee, the mechanism triggering conciliation, and, naturally enough, the updating of the provisions of the Financial Regulation directly affected by the changes introduced by the Lisbon Treaty (i.e. the abolition of the distinction between CE and NCE, a new codecision procedure for transfers, etc.);

Following the entry into force of the Treaty between the Kingdom of Belgium, the Federal Republic of Germany, the Kingdom of Spain, the French Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Republic of Austria on the stepping up of cross-border cooperation, particularly in combating terrorism, cross-border crime and illegal migration hereinafter (Prüm Treaty), this initiative is submitted, in consultation with the European Commission, in compliance with the provisions of the Treaty on European Union, with the aim of incorporating the substance of the provisions of the Prüm Treaty into the legal framework ...[+++]of the European Union.

2. Is of the view that Protocol No 6 on the Internal Market and Competition should be exercised with prudence and that the Treaty provision "the Union shall, if necessary, take action under the provisions of the Treaties" should be clarified by reference to the other provisions of the Treaties and the acquis communautaire;

Without prejudice to the other provisions of the Treaties, the Council, acting unanimously in accordance with a special legislative procedure and after consulting the European Parliament, may adopt provisions to confer jurisdiction, to the extent that it shall determine, on the Court of Justice of the European Union in disputes relating to the application of acts adopted on the basis of the Treaties which create European intellectual property rights.

(11) The competence of the European Community to conclude or accede to international agreements or treaties does not derive only from explicit conferral by the Treaty but may also derive from other provisions of the Treaty and from acts adopted pursuant to those provisions by Community institutions.
