(13) Pour l’application du paragraphe (11), le présent article est interprété sans égard au paragraphe (12) pour ce qui est d’un bien sur lequel un contribuable ou une société de personnes possède une tenure à bail et qui, d’une part, est compris dans la catégorie 1, 3 ou 6 de l’annexe II en vertu du paragraphe 1102(5) et, d’autre part, est loué à bail par le contribuable ou la société de personnes au propriétaire du terrain où est situé le bien ou à une personne qui possède un droit sur le terrain ou une option le visant.
(13) For the purposes of subsection (11), where a taxpayer or partnership has a leasehold interest in a property that is property of Class 1, 3 or 6 in Schedule II by virtue of subsection 1102(5) and the property is leased by the taxpayer or partnership to a person who owns the land, an interest therein or an option in respect thereof, on which the property is situated, this section shall be read without reference to subsection (12) with respect to that property.
