(l.3) where before the amalgamation property of a predecessor corporation was unlawfully taken, lost, destroyed or taken under statutory authority, or was a former business property of the predecessor corporation, for the purposes of applying sections 13 and 44 and the definition “former business property” in subsection 248(1) to the new corporation in respect of the property and any replacement property acquired therefor, the new corporation shall be deemed to be the same corporation as, and a continuation of, the predecessor corporation;

(b) the aggregate of the income tax that would be payable under Part I of the Act by Spruce Falls for the year and the interest and penalties in respect thereof that would be payable by it under the Act for the year, if subsections 13(4) and (4.1) and section 44 of the Act were to apply to the assignment by Spruce Falls of the Water Power Lease Agreement to Ontario Hydro and the acquisition by Spruce Falls of the Power Rights Agreement as if the Water Power Lease Agreement were a former business property and the Power Rights Agreement were depreciable property acquired as a replacement for that former business property, as those terms ar ...[+++]e defined for the purposes of the Act, and as if Spruce Falls had elected under subsection 13(4) of the Act as and when required for that subsection to apply with respect to the disposition of the Water Power Lease Agreement and the acquisition of the Power Rights Agreement.

(i) subsections 13(4) and 44(1) of the Act are treated by Spruce Falls as applying in respect of the assignment by Spruce Falls of the Water Power Lease Agreement to Ontario Hydro and the acquisition by Spruce Falls of the Power Rights Agreement as if the Water Power Lease Agreement were a former business property and the Power Rights Agreement were depreciable property acquired as a replacement for that former business property, as those terms are defined for the purposes of the Act, and as if Spruce Falls had elected under subsection 13(4) of the Act as and when required for that subsection to apply with respect to the disposition of t ...[+++]he Water Power Lease Agreement and the acquisition of the Power Rights Agreement, and

(6) If in a taxation year (in this subsection referred to as the “initial year”) a taxpayer disposes of an eligible capital property (in this section referred to as the taxpayer’s “former property”) and the taxpayer so elects under this subsection in the taxpayer’s return of income for the year in which the taxpayer acquires an eligible capital property that is a replacement property for the taxpayer’s former property, the amount, not exceeding the amount that would otherwise be included in the amount determined for E in the definition “cumulative eligible capital” in subsection (5) (if the description of E in that definition were read ...[+++]without reference to “3/4 of”) in respect of a business, that has been used by the taxpayer to acquire the replacement property before the later of the end of the first taxation year after the initial year and 12 months after the end of the initial year
