Ces réformes législatives ont eu pour but notamment de garantir une plus grande individualisation des mesures prononcées, afin de permettre aux personnes protégées de pouvoir conserver l'exercice de certains droits, et de garantir la mise en place, à l'avance, des dispositifs de protection éventuels: c'est le cas par exemple avec le Lasting power of Attorney de droit anglais, qui est un acte librement établi, sous seing privé, par une personne seule, ou assistée d'un conseil, ou le Vollmacht de droit allemand, pouvant être effectué sous seing privé, ou par acte notarié lorsqu'il comporte un acte de disposition.
