As the Court of First Instance observed on this point in Case T-7/89 (15): it would be artificial to split up such continuous conduct, characterized by a single purpose, by treating it as a number of separate infringements: 'The fact is that the (undertakings) took part - over a period of years - in an integrated set of schemes constituting a single infringement, which progressively manifested itself in both unlawful agreements and unlawful concerted practices.`
Ainsi que le Tribunal de première instance l'a souligné, à cet égard, dans l'affaire T-7/89 (15), il serait artificiel de subdiviser ce comportement continu, caractérisé par une seule finalité, en y voyant plusieurs infractions distinctes. Ce même tribunal ajoute qu'«en effet, [les entreprises ont] pris part - pendant des années - à un ensemble intégré de systèmes qui constituent une infraction unique qui s'est progressivement concrétisée tant par des accords que par des pratiques concertées illicites».
