Several grounds are given for including site owners and occupiers of the land as liable parties: because they have a long-standing duty to keep their land in a safe condition or because they either have profited from the presence of the pollutants or will profit from the clean-up; and because exposing purchasers to this liability risk provides an incentive for them to investigate land thoroughly before they take possession of it, so helping to identify pollution problems.
